1. PROVISION OF SERVICES
1.1. All orders must be confirmed in writing.
1.2. All information is given in good faith.
1.3. Upon agreement with the client, my interior stylist (hereunder referred to as "MIS") may amend the type of goods and services previously recommended in writing.
1.4. For all non redesign/makeovers services, MIS does not give any guarantee that the client will find buyers or tenants within a specific time or that the value of the property or rental will increase within a specific limit.
1.5. All recommendations given by MIS are of aesthetic/cosmetic nature only. MIS's consultants are not qualified to provide structural recommendations. Such recommendations should be provided by a qualified building surveyor and/or a structural engineer.
1.6. Cellars and loft spaces will not be inspected. MIS reserves the right to exclude any other areas which may have limited or unsafe access.
1.7. Before implementing any recommendations given by MIS, the client should ensure that they are satisfied with the cost effectiveness of these recommendations. The client should take the necessary health and safety precautions prior to undertaking any recommended work.
2. VALIDITY
2.1. All information, suggestion, recommendations given by MIS whether verbally or in writing is only valid for 45 days from the date thereof.
2.2. These terms and conditions will automatically apply when the client orders any services.
3. PAYMENT TERMS
3.1. MIS's home restyling services, home staging consultations and reports are payable into two instalments : 50 % deposit prior commencement of the service and the balance payable on completion or by arrangement. Project management services which are over a 3 week period are payable into three instalments : 30% prior commencement, 40% in the middle of the project and the balance on completion. Payments are due immediately on presentation of invoice. Commencement of services will only start once payment of the deposit is fully cleared. Cost of supplies, goods and material bought by MIS on behalf of the clients are payable in advance prior the purchase.
3.2. Payment can be made in cash, cheque, or bank transfer (bank details are provided on request and with the invoice). Cheques are only accepted on the basis of being paid on first presentation. The client will be liable to pay an administrative charge of £38 for each cheque returned unpaid whether or not the cheque is honoured on representation.
3.3. The client is liable for any additional cost of congestion charges and parking meter charges for central London location incurred by MIS's consultants when travelling to the property.
3.4. The client will be responsible for the payment of third party suppliers introduced by MIS.
3.6. Depending on the location of the property and upon agreement with the client, additional charges for travel and accommodation may be payable by the client. Daily additional travel charges will be payable by the client for any project lasting 5 days or more. The amount will depend on the location of the property and will be communicated to the client prior commencement of the work.
3.6. MIS's may charge the client 5% interest rate above the base rate of The Bank of England shall the client fail to settle any outstanding payment. Interests would apply from the due date until full settlement is received. Should the need arise for MIS to instruct a debt recovery agency or to instigate legal proceedings, the client will be liable for any costs so incurred.
4. TIMESCALE
MIS shall inform the client of the date of commencement of work and an estimated completion date. Any date given is an estimate only. Whilst MIS will always endeavour to complete the services within estimated date, MIS shall not be held liable for any delay in completing the services.
5. BUDGET
5.1 All costings are estimates.
5.2 MIS will inform the client as soon as possible if the estimate is to be exceeded.
5.3 Basic cost reports will be provided at the end of a project, or monthly for long running projects. Full detailed reports can be provided, for an additional charge.
6. CLIENT'S OBLIGATIONS
6.1. The client shall give access to the property, at all reasonable times, to MIS's consultants or representatives, sub-contractors, suppliers for the purpose of providing services, goods and material.
6.2. The client shall ensure that water and electric supplies are available at the property to carry out services at no extra cost to MIS.
6.3. The client is liable for any loss or damage to any goods, materials, tools or equipment delivered to or stored at the property unless MIS's consultants, representative, suppliers fail to take reasonable care.
6.4. The client shall ensure to have adequate home content insurance to cover all items provided to the client by MIS on a temporary basis. Any damage or shortage of items must be reported in writing within 48 hours. MIS is not liable for any missing or damaged items after delivery and installation.
7. MIS'S OBLIGATIONS
7.1. MIS must supply goods and material of reasonable quality and adequate for their purpose
7.2. MIS shall provide the services using reasonable care and skill
7.3. MIS shall inform the client of any necessary changes of services or goods prior completion
7.4. MIS shall use any personal information in accordance with the Data Protection Act 1998 and other applicable laws.
8. THIRD PARTIES
8.1. The client may use his own contacts and suppliers. Shall MIS introduce third party suppliers, tradespersons or other specialists to the client, the client will form a direct contract with the third party and be responsible for the contractual relationship and all payments due to the third party unless otherwise arranged.
8.2. If project management is requested by the client, the client will remain responsible for all financial aspects and full settlement of all services provided.
9. CANCELLATION
9.1. No administration charges will apply to the Client if the appointment is cancelled up to 48 hours prior the Appointment date & time.
9.2. Cancellation made between 48 and 24 hours prior to the appointment date will incur a £50 charge to the Client or any other expenses paid by the Consultant in relation to the appointment (travel, accommodation, goods and deposit to third parties) in excess of £50 - whichever is the greater.
9.3. Cancellation made less than 24 hours prior to the appointment will incur a £100 charge or any other expenses paid by the Consultant in relation to the appointment (travel, accommodation, goods and deposit to third parties) in excess of £100 - whichever is the greater.
9.4. The client may cancel the contract after commencement of the services and will be liable for the payment of all services provided up to the date of cancellation.
10. GENERAL
10.1. MIS shall not be liable for any failure to provide the service due to unexpected circumstances or circumstances beyond its control.
10.2. MIS may use photographs or other type of footage of the property for publicity, advertising or promotion purpose but the identify of the property owner shall not be revealed.
11. PUBLIC LIABILITY INSURANCE
MIS has public liability insurance to £1,000,000 for interior design with Master Tradesman Plus.
12. FORCE MAJEURE
MIS will not be liable to the client for any breach of contract arising from or which may have been caused by Act of God, force majeure, war, riot, civil commotion, Government orders, direction or legislation by fire, accident, strike, or other industrial action, adverse weather conditions, delays in transport or by any other matter which MIS has no control.
These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales. Both the Client and MIS shall submit any dispute arising hereunder to the exclusive jurisdiction of the Courts of England and Wales.
